ApnaMusic, operated by ApnaMedia Group (headquartered in Dubai, UAE), deeply respects the intellectual property rights of all creators, artists, labels, and rights holders. We are committed to complying with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. §512), the UAE Federal Law No. 38/2021 on Copyright and Neighboring Rights, and all applicable international copyright laws under the Berne Convention.

We do not condone, encourage, or knowingly permit copyright infringement on our platform. All content is either licensed, distributed with consent, user-uploaded with ownership verification, or provided for promotional and informational purposes.

DMCA Safe Harbor Compliance

As an online service provider, ApnaMusic qualifies for safe harbor protection under 17 U.S.C. §512 by maintaining the following policies:

  • Designated DMCA Agent: We have registered a designated agent with the U.S. Copyright Office to receive and process infringement notifications.
  • No Knowledge Policy: We do not actively monitor all uploaded content for infringement but act promptly upon receiving valid takedown notices.
  • Repeat Infringer Policy: We maintain a policy of terminating access for users who are repeat infringers of copyright.
  • Standard Technical Measures: We accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works.
  • No Financial Benefit: We do not derive direct financial benefit from any content that we have the right and ability to control that infringes copyright.

Filing a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on ApnaMusic infringes your copyright, please submit a written notification containing the following information as required by 17 U.S.C. §512(c)(3):

  1. Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, a representative list.
  2. Identification of the infringing material and information reasonably sufficient to allow us to locate it (e.g., the specific URL(s) of the page(s) containing the material).
  3. Your contact information: Full legal name, mailing address, telephone number, and email address.
  4. A good faith statement: "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  5. An accuracy statement under penalty of perjury: "The information in this notification is accurate, and I am the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Your physical or electronic signature.

Counter-Notification Procedure

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. §512(g). Your counter-notice must include:

  1. Identification of the material that was removed and the location at which it appeared before removal.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  3. Your name, address, telephone number, and email address.
  4. A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which ApnaMusic may be found).
  5. Your physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If no court action is filed within 10–14 business days, we may restore the removed content.

Repeat Infringer Policy

In accordance with the DMCA, ApnaMusic maintains a policy of:

  • Tracking takedown notices associated with user accounts and IP addresses.
  • Issuing warnings for first-time offenses.
  • Suspending accounts after two valid infringement notices.
  • Permanently terminating accounts of users who are repeat infringers (three or more valid notices).

Content Monitoring

While we do not proactively monitor all user-uploaded content (to maintain safe harbor protections), we employ:

  • Automated content filtering for known copyrighted material.
  • Manual review processes for flagged content.
  • Community reporting tools for users to flag potential infringement.
